In Texas, “sexual assault of a child” is the official name for a crime more commonly known as “statutory rape.” In other words, any sexual contact with a person under the age of 17 can be considered a form of sexual assault by someone at least three years older than the young person in question — even when the younger person has expressed his or her consent for a given sexual activity. This law is based on the premise that children under the age of 17 are too young to give meaningful, legally significant consent for sex with an older partner. Sexual assault against a child also meets the broader definition of sexual assault when sexual contact occurs without one party’s consent.
