How a mutual combat defense can affect a Texas assault charge

On Behalf of R. Todd Bennett, P.C. | Jun 24, 2026 | Violent Crimes |

Physical altercations can potentially result in assault charges. Those involved in a fight, especially one that causes injuries or occurs in a public place, could be at risk of prosecution. The other person could report the incident to police. Anyone passing by might contact local authorities.

Assault charges can lead to fines, jail time and a criminal record. There are numerous defense strategies that can help people accused of assault in Texas avoid a criminal conviction with life-altering consequences.

Some people may be able to claim that they acted in self-defense. Others might be able to prove that they engaged in mutual combat with the other person. A claim of mutual combat could help people avoid an assault conviction.

What is mutual combat?

Mutual combat is essentially an agreement to settle a matter through physical force. Simple fist fights that do not involve weapons or produce grievous physical injuries can constitute mutual combat if both parties agree to the fight.

Mutual combat can occur through a written arrangement or a verbal discussion. Non-verbal communication can also constitute an agreement to engage in mutual combat.

Establishing that the altercation was a form of mutual combat rather than a one-sided attack could be an effective defense strategy when facing assault charges. However, prosecutors could still potentially bring charges related to the fight, especially if it occurred in a public setting or disrupted traffic.

Reviewing the circumstances leading to an assault charge with an experienced legal professional can help defendants limit the risk of a conviction. Depending on the circumstances, there are many defense strategies that help people avoid assault convictions.
