4 Defenses against drug charges

On Behalf of R. Todd Bennett, P.C. | Mar 25, 2019 | Drug Charges |

Charges for drug possession in Texas are no slap on the wrist. In fact, even marijuana users could face jail time for any amount of the substance.

However, there are several ways an attorney can help defend your case to get you the best outcome possible. Here are just a few.

Missing evidence

After the police collect evidence at the crime scene, it may go through a number of parties between being shipped, stored, analyzed and presented in court. One of the easiest ways an attorney can decriminalize a defendant is if the proof of the crime goes missing during this process.

This has been known to happen.

Tampering with the evidence

Another way evidence from a scene may be deemed invalid is if it was somehow mishandled by law enforcement officials. By working with an attorney as soon as possible, he or she can investigate whether the police had a warrant or right to search for the evidence they obtained.

Likewise, if the evidence was used in a prior case or not recorded correctly, it may not be admissible in court either.

Lab results

There have been cases in which falsified lab results caused defendants to be falsely imprisoned for drug possession. A skilled attorney will closely involve themselves in the lab work of the evidence to assure that laundry detergent isn’t mistaken for cocaine.

Witnesses and footage at the scene

A lawyer can also help you gather testimonies from eyewitnesses and/or footage from nearby security cameras. This may help poke holes in the narrative that’s being told about how the events unfolded.

Depending on the circumstance, this evidence can sometimes exclude a defendant from the scene or the crime.

Drug court

A lawyer can also help those who have dependency issues seek rehabilitation and treatment options in place of harsh sentences. By attending drug court, defendants can avoid jail time and future offenses.

To learn more about the defense options available for your case, talk to criminal defense lawyer about the specifics of your unique situation. An attorney can help you prepare a defense and make negotiations in your favor.
