False accusations of domestic violence can be defended against

On Behalf of R. Todd Bennett, P.C. | Jun 28, 2017 | Domestic Violence |

Money doesn’t buy everything, and even though you’re very well off, you still face the threat of a domestic violence charge. You’ve been accused of actions you did not commit, and now you’re not sure what to do.

There are several defenses you can use in response to domestic violence accusations. It’s a good idea to protect yourself early on, because a domestic violence charge and conviction could cause damage to your reputation, business and other factors of your life.

1. Show there is no proof

A domestic violence victim typically has injuries to prove that he or she was attacked. Additionally, neighbors or other people may have witnessed or heard the dispute taking place in the home. If there is no proof or the prosecution lacks proof, you may be able to have the charge dismissed completely.

2. Explain your actions as self-defense

It is not uncommon for a violent person to change the story around to accuse the victim. If you are the person who was victimized and not the person who was being violent to the other, you deserve to be protected. Showing that you were defending yourself is possible if you have your injuries analyzed or if you have proof of previous attacks.

3. Show that the allegations are deliberate and false

If you’re going through a divorce or your spouse has been threatening to keep your children from you, a false accusation of abuse could do just that. It’s important to keep all proof of threatening behavior to give to your attorney if this is happening. Your attorney will need to show inconsistencies in the accuser’s story to help you show that he or she made false accusations against you.

If you’re facing these charges, you don’t need to face them alone. Your attorney can help you build a strong defense, so you can show what really happened.
