Examining common drunk driving defense strategies

Despite the many laws and punishments in place to curb drunk driving, this remains a major problem in the state of Texas (as well as the rest of the United States).

If you find yourself in trouble with the law for any reason, it’s imperative to learn more about your charges. From there, you should also collect information regarding defense strategies and your legal rights.

All of this holds true with a drunk driving arrest. Here are several defense strategies that you can use to your advantage:

— Improper stop. Do you have reason to believe that the officer did not have probable cause to pull over your vehicle? This can be one of the best drunk driving defense strategies.

— Inaccurate administration of a field sobriety test. Police officers use field sobriety tests to determine if a driver is actually drunk. However, the inaccurate administration of a test can lead to inaccurate results.

— Accuracy of a Breathalyzer test. A Breathalyzer test is not always accurate. There are many causes of an inaccurate reading, such as equipment that is not properly maintained.

— Rising blood alcohol level. This may not be the best most common drunk driving defense strategy, but it’s one to consider. With this, you claim that your blood alcohol level was below the legal limit when driving and did not rise until the administration of a breath test.

The type of drunk driving defense strategy that you use depends on the details surrounding your arrest. In other words, the strategy that you employ may not work for the next person.

With so many strategies to consider and details to contend with, it’s imperative to consult with a DUI attorney immediately following your arrest. This will help you better understand the details surrounding your arrest, your current situation, how to fight for your rights, and what will happen in the event of a conviction.

As unfortunate as it may be, many people are improperly arrested for drunk driving every year. When you take the right steps from day one, it’s much easier to avoid the most serious punishment (or any punishment at all).
