Men face prison time and fines in Texas theft case

Authorities say that a 32-year-old man, a 35-year-old man and a 42-year-old man, all from Odessa, were indicted on eight charges of access device fraud. A fourth man from Gardendale was also included in the indictment. Three of the suspects were taken into custody on July 13 while the last suspect was taken into custody on July 14.

According to authorities, the men made $365,000 worth of bulk diesel fuel purchases between January and September 2014. They made the purchases with eight stolen fuel cards. If convicted, the men could each spend a decade in federal prison and pay a fine of up to $250,000.

Individuals who steal merchandise or acquire merchandise that they know is stolen could be charged with theft. Theft crimes may be misdemeanors or felonies depending on the value of the goods stolen. This means that it may be possible to spend many years in prison in addition to paying a large fine. Individuals who are facing theft or related charges may wish to talk to an attorney about their case.

Legal counsel may be able to create a defense to the charge in the hopes of earning an acquittal. It may also be possible for the charges to be thrown out if evidence is suppressed or otherwise proven unreliable in court. If an acquittal occurs, the case is resolved with a defendant facing no further penalties, and it may be possible to get the charge sealed or expunged. If a plea agreement is reached, it may reduce the amount of any fines paid or the amount of jail time an individual must serve.
