2 men face drug charges after traffic stop and raid

Two men in Texas were taken into police custody on drug charges after a traffic stop on June 3. Prior to the traffic stop, authorities in Bowie County had been conducting surveillance near a house where they believed people were committing drug offenses. After a vehicle was seen leaving the house, a Bowie County sheriff's deputy stopped the car for a traffic violation.

According to a statement from the sheriff's deputy, the 41-year-old man who was stopped in his vehicle appeared to be exceptionally nervous. Though the man initially said that there was nothing illegal in his car, he admitted that he had methadone when the deputy said he was going to search the car. The deputy found 321.5 grams of methadone divided into eight bottles.

After taking the first man into custody, authorities got a warrant to search the house that they had been observing earlier. During the search, authorities seized more methadone, marijuana, syringes, plastic bags, digital scales and other pills. A 61-year-old man who was in the house was taken into custody. Both of the accused men were charged for possession of a controlled dangerous substance. The older man was also charged for possession of marijuana and possession of a dangerous drug.

When authorities find controlled substances along with digital scales and plastic bags in a residence, the evidence could lead prosecutors to file charges for possession with intent to sell. A criminal defense attorney might be able to help a defendant who has been charged with such a crime to negotiate for a reduced charge of simple possession. An attorney might argue that certain items seized during a raid were not intended for drug sales.
